GAME OF CHANCE PROMOTION WITH GRAHAMS NATURAL TERMS AND CONDITIONS

  1. Instructions on how to enter this promotion form part of these Terms and Conditions and entry into this promotion is deemed acceptance of these Terms and Conditions. The Promotion commences on Tuesday 22nd October 6pm and ends on Monday 2nd December 2024 at 11:59pm (AEST - Brisbane).
  1. This is a game of chance.
  1. The Total Prize is $10,000AUD cash prize. If an entrant is drawn who resides outside of Australia, the cash prize will be converted directly into the currency used in the country they reside in. 1(one) winner will be drawn via electronic drawing system 2 working days after the competition date has closed. Draw date, 10am on Wednesday 4th December 2024 (AEST- Brisbane) at Grahams Natural Head Office in Australia – 19 City Link Drive, Carrara QLD 4211. There will be only 1 (one) winner for this prize.
  1. To be eligible to enter the Promotion, individuals must do the following during the Promotional Period: Purchase any products from the Graham Natural  range to the value (excluding shipping) of $50 USD at www.grahamsnatural.com or £50 GBP at www.grahamsnatural.co.uk or $50 AUD at www.grahamsnatural.com.au to go into the draw automatically. You must also be subscribed to marketing via email in order to enter.
  1. The winner will be notified by email and phone within 2 business days of the draw. The winner’s first name and state will be posted on the Grahams Natural website www.grahamsnatural.com / www.grahamsnatural.com.au / www.grahamsnatural.co.uk within 2 business days after the winner has been notified. The Promoter will attempt contact 3 times within the week in which the winner is drawn. 
    Grahams Natural also has permission to publish the winner’s first name and state via all social media platforms including Instagram @grahamsnatural & @grahamsnatural_aunz TikTok @theeczemadiaries @grahamsnatural Facebook Grahams Natural Alternatives & Grahams Natural AUS.
  1. Multiple entries are permitted, provided each separate entry is processed through either www.grahamsnatural.com / www.grahamsnatural.com.au / www.grahamsnatural.co.uk . Every purchase over $50 USD / $50 AUD / £50 GBP will go in the draw. No requirement to fill out any further forms. You will be notified by email that you are in the draw.
  1. Entry is open to Australian, New Zealand, United States of America, Canadian and Great Britain residents aged 18 years or over. 
  1. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, stepparent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, stepbrother, step-sister or 1st cousin. 
  1. The Promoter reserves the right, at any time, to verify the entrant’s entry (including a claimant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the claim process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved. 
  1. The Promoter is not responsible for any incorrect information provided by the Entrant.
  1. Incomplete or indecipherable entries will be deemed invalid.
  1. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Entrant. 
  1. The Promoter is not responsible for any action, event, loss or damage direct or direct or indirect after the prize has been issued or sent to the Entrant. 
  1. The Prize is not transferable or exchangeable. 
  1. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a successful winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. 
  1. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any claimant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate. 
  1. Any cost associated with accessing the promotional website is the claimant’s responsibility and is dependent on the Internet service provider used.
  1. The use of any automated software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“NonExcludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion. 
  1. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in the Prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a entrant; or (f) use of the Prize. 
  1. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle.

    In addition to any use that may be outlined in the Promoters Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the claimant. All entries become the property of the Promoter. The Promoter will not disclose the entrant’s personal information to any entity outside of Australia. 
  1. Early cancellation of competition
    (a) If, for any reason (in our opinion, which is final), we are not able to run the
    competition as planned, including, but not limited to, infection by a computer
    virus, bug, tampering, unauthorised intervention, technical failures, security
    breach or any other causes that corrupt or affect the administration, security,
    fairness, integrity or proper conduct of the competition, we may, in our sole
    discretion, cancel, terminate, modify or suspend the competition subject to
    any applicable legislation.

    (b) In the event of war, terrorism, state of emergency, disaster or any other
    circumstance beyond our control, we may, subject to applicable legislation,
    cancel, terminate, modify or suspend the competition.

  1. Jurisdiction
    (a) This document is governed by the law in force in Queensland, Australia
    (Jurisdiction).
    (b) Each party submits to the exclusive jurisdiction of the courts of the Jurisdiction
    and the courts competent to determine appeals from those courts, in relation
    to any proceedings that may be brought at any time relating to this document.
    (c) Each party irrevocably waives any objection it may have now or in the future
    to the venue of any proceedings where that venue falls within the Jurisdiction.
